Welcome and thank you for visiting buddybeautyworks.com (“Site”) and for reviewing our Terms and Conditions (“Terms”). We are delighted to share with you our exclusive line of fragrance mists and personal care products designed to inspire confidence and self-expression through unforgettable scents.

These Terms govern your access to and use of our Site, our online store, and all products, services, and features offered through our platform (collectively, the “Offerings”). By accessing, browsing, or purchasing through our Site, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy, which is incorporated herein by reference.

If you do not agree to these Terms, please do not access or use our Site, or purchase or use any of our products.

PLEASE REVIEW THE TERMS CAREFULLY, PARTICULARLY SECTION 5.2 DETAILING ANY SUBSCRIPTION RENEWAL TERMS, SECTION 21.1 RELATED TO INGREDIENT SENSITIVITIES, AND SECTION 24 RELATED TO BINDING ARBITRATION.

BUDDY BEAUTY WORKS LLC (“BUDDY BEAUTY WORKS,” “WE,” “OUR,” “US,” OR “COMPANY”) OPERATES THIS SITE. BY CLICKING ON THE “PLACE ORDER” BUTTON, COMPLETING THE REGISTRATION PROCESS, OR ACCESSING OR USING THE SITE, YOU REPRESENT THAT:

(1) YOU HAVE READ, UNDERSTAND, AND AGREE TO BE BOUND BY THESE TERMS,
(2) YOU ARE OF LEGAL AGE TO FORM A BINDING CONTRACT WITH THE COMPANY, AND
(3) YOU HAVE THE AUTHORITY TO ENTER INTO THE TERMS OF USE PERSONALLY OR ON BEHALF OF THE COMPANY YOU HAVE NAMED AS THE USER, AND TO BIND THAT COMPANY TO THESE TERMS.

THE TERM “YOU” REFERS TO THE INDIVIDUAL OR LEGAL ENTITY, AS APPLICABLE, IDENTIFIED AS THE USER WHEN YOU REGISTERED ON THE SITE. IF YOU DO NOT AGREE TO BE BOUND BY THESE TERMS, YOU MAY NOT ACCESS OR USE THIS SITE OR THE OFFERINGS.

IF YOU SUBSCRIBE TO ANY SERVICE (AS DEFINED IN SECTION 5 BELOW) FOR A TERM, THEN THE TERMS WILL BE AUTOMATICALLY RENEWED FOR ADDITIONAL PERIODS OF THE SAME DURATION AS THE INITIAL TERM AT BUDDY BEAUTY WORKS’ CURRENT FEE FOR SUCH SERVICES UNLESS YOU DECLINE TO RENEW YOUR SUBSCRIPTION IN ACCORDANCE WITH SECTIONS 5.2 AND 10.3 BELOW.

PLEASE BE AWARE THAT SECTION 24 OF THIS AGREEMENT CONTAINS PROVISIONS GOVERNING HOW DISPUTES THAT YOU AND WE HAVE AGAINST EACH OTHER ARE RESOLVED, INCLUDING, WITHOUT LIMITATION, ANY DISPUTES THAT AROSE OR WERE ASSERTED PRIOR TO THE EFFECTIVE DATE OF THIS AGREEMENT.

IN PARTICULAR, IT CONTAINS AN ARBITRATION AGREEMENT WHICH WILL, WITH LIMITED EXCEPTIONS, REQUIRE DISPUTES BETWEEN US TO BE SUBMITTED TO BINDING AND FINAL ARBITRATION. UNLESS YOU OPT OUT OF THE ARBITRATION AGREEMENT:

(1) YOU WILL ONLY BE PERMITTED TO PURSUE DISPUTES OR CLAIMS AND SEEK RELIEF AGAINST US ON AN INDIVIDUAL BASIS, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE ACTION OR PROCEEDING; AND
(2) YOU ARE WAIVING YOUR RIGHT TO PURSUE DISPUTES OR CLAIMS AND SEEK RELIEF IN A COURT OF LAW AND YOUR RIGHT TO HAVE A JURY TRIAL.

ANY DISPUTE, CLAIM, OR REQUEST FOR RELIEF RELATING IN ANY WAY TO YOUR USE OF THE SITE WILL BE GOVERNED AND INTERPRETED BY AND UNDER THE LAWS OF THE STATE OF FLORIDA CONSISTENT WITH THE FEDERAL ARBITRATION ACT, WITHOUT GIVING EFFECT TO ANY PRINCIPLES THAT PROVIDE FOR THE APPLICATION OF THE LAW OF ANY OTHER JURISDICTION. THE UNITED NATIONS CONVENTION ON CONTRACTS FOR THE INTERNATIONAL SALE OF GOODS IS EXPRESSLY EXCLUDED FROM THIS AGREEMENT.

Please note that the Site, the goods or services offered through the Site, including but not limited to any product sales or promotional programs (collectively, the “Products”), the text, audio, video, graphics, or other content featured on the Site (“Content”), any Buddy Beauty Works gift cards or gift certificates (including, for purposes of these Terms, electronic versions of both) (“Gift Cards”), and any trial offers, sweepstakes, contests, or promotions (“Vouchers,” as defined in Section 9), are collectively referred to in these Terms as the “Offerings.”

Your use of, and participation in, certain Offerings may be subject to additional terms (“Supplemental Terms”), which will either be referenced within these Terms or presented to you for acceptance when you engage with the applicable Offering. Supplemental Terms include the Buddy Beauty Works Privacy Policy, Gift Card Terms, Promotion Rules, and any other applicable operating rules, policies, or documents published on the Site. If any conflict arises between these Terms and the Supplemental Terms, these Terms shall prevail.

These Terms and any applicable Supplemental Terms together constitute the “Agreement.”

As further explained in Section 3, please note that this Agreement may be modified by Buddy Beauty Works LLC at its sole discretion at any time. When changes are made, we will update the Terms on the Site and notify users via email, if applicable. We will also update the “Effective Date” at the top of this page. If you do not agree with the updated Terms, you must discontinue your use of the Site and Offerings. Continued use after any such modification constitutes your acceptance of the revised Terms.

Please regularly check the Site to review the most current version of the Terms.

You are encouraged to print or save a copy of these Terms and Conditions for future reference.

1. INFORMATION ABOUT US

Buddy Beauty Works LLC is a limited liability company registered in the State of Florida, with its principal business address at 8925 SW 172ND AVE, Miami, FL 33196, and telephone number (+1 786-861-9650).

Buddy Beauty Works LLC is the official distributor of the Buddy Beauty Works® brand in the United States, offering a curated line of fragrance mists and personal care products designed to deliver unique, long-lasting scents that inspire confidence and self-expression.

This website, www.buddybeautyworks.com, is operated through the Shopify platform to provide secure and convenient access to our products and services.

 

2. SERVICE AVAILABILITY AND YOUR STATUS

The Site and Offerings are intended for use by individuals located within the contiguous United States, excluding Alaska, Hawaii, Puerto Rico, and other U.S. territories (“Serviced States”).

At this time, Buddy Beauty Works LLC does not accept or fulfill orders placed from outside the Serviced States. By placing an order through our Site, you represent and warrant that you:

1. Are legally capable of entering into this Agreement,

2. Are at least 18 years of age,

3. Are a resident of a Serviced State, and

4. Are accessing and using the Site from within a Serviced State.

 

3. MODIFICATION

At its sole discretion, Buddy Beauty Works LLC reserves the right to change, amend, add to, remove, or supplement these Terms and Conditions (including the Privacy Policy) at any time and without prior notice.

However, any changes to the procedures applicable to the resolution of disputes shall only apply to disputes that arise after the updated provisions are published on the Site.

If any material changes are made to these Terms, Buddy Beauty Works LLC will notify registered users via email and update the “Effective Date” displayed at the top of this page.

 

4. REGISTRATION

4.1 Registering Your Account

To access certain features or services available on the Site, you may be required to create an account and become a Registered User.

A “Registered User” refers to any individual who has either:

(1.) Created an account directly on the Buddy Beauty Works website (an “Account”), or

(2.) Accessed the Site through a valid account on a third-party social networking service (SNS) connected to our platform (a “Third-Party Account”).

By registering, you agree to provide accurate, current, and complete information and to maintain the confidentiality of your login credentials. You are responsible for all activities conducted under your Account or Third-Party Account.

4.2 Access Through a SNS

If you access the Site through a social networking service (SNS), you may link your Buddy Beauty Works Account by allowing Buddy Beauty Works LLC to access your Third-Party Account as permitted under the terms and privacy settings of that SNS.

By doing so, you represent and warrant that you have the authority to grant such access and to share the information available through your Third-Party Account.

Buddy Beauty Works LLC is not responsible or liable for any content, activity, or data shared through your SNS account settings. You may disconnect your Third-Party Account from your Buddy Beauty Works Account at any time through your account settings.

4.3 Registration Data

If you create an Account, you agree to:

1. Provide accurate, complete, and current information, and promptly update it as necessary.

2. Maintain the confidentiality and security of your password, and notify us at support@buddybeautyworks.com or by phone at +1 (786) 861-9650 within 48 hours if you suspect any unauthorized access or use of your Account.

3. Log out of your Account at the end of each session to help protect your information.

You affirm that you are at least 18 years of age and are not prohibited from using the Site under applicable law. You may not share your Account, use another person’s credentials, or create an Account using a false identity or inaccurate information.

Buddy Beauty Works LLC reserves the right to suspend or terminate any Account that violates these Terms or is deemed to present a security or misuse risk. You acknowledge that your Account and related data remain the property of Buddy Beauty Works LLC.

YOU WILL BE SOLELY RESPONSIBLE FOR ALL ACCESS TO AND USE OF THE SITE AND SERVICES BY ANYONE USING YOUR ACCOUNT, WHETHER AUTHORIZED OR NOT, INCLUDING ALL COMMUNICATIONS, TRANSACTIONS, AND FINANCIAL OBLIGATIONS INCURRED THROUGH SUCH USE. BUDDY BEAUTY WORKS LLC SHALL NOT BE LIABLE FOR ANY LOSS OR DAMAGE RESULTING FROM YOUR FAILURE TO MAINTAIN THE CONFIDENTIALITY OF YOUR ACCOUNT CREDENTIALS.

4.4 Communication

By providing your phone number, you consent to receive text messages and phone calls from Buddy Beauty Works LLC, including automated or prerecorded messages, for the following purposes:

(i) Account notifications
(ii) Order and delivery updates
(iii) Payment or billing inquiries
(iv) Promotions and exclusive offers
(v) Cart reminders or follow-ups

Message frequency may vary. To opt out of promotional messages, reply “STOP” at any time. For assistance, reply “HELP” or email us at support@buddybeautyworks.com. Standard message and data rates may apply depending on your mobile carrier.

You are responsible for keeping your contact information, including your phone number, accurate and up to date in your Account settings.

Buddy Beauty Works LLC may share your phone number with trusted third-party service providers solely as necessary to fulfill the communication purposes described above. We may monitor or record communications for training, compliance, and quality assurance.

 

5. COSMÉTICA MOLECULAR LLC SERVICES

5.1 Subscription Service

Buddy Beauty Works LLC offers an optional, automatic, and recurring subscription service for select fragrance and personal care products (the “Subscription Service” or “Service”). Customers may choose from various available subscription plans (“Plans”) depending on product preferences and delivery frequency.

With your first subscription order, you may receive a promotional starter set or exclusive launch kit when available. Shipping fees or promotional conditions will be clearly disclosed at checkout prior to confirming your order.

Unless otherwise stated, subscription plans renew automatically based on the selected frequency and payment method. By subscribing, you authorize Buddy Beauty Works LLC (through Shopify Payments, PayPal, or Stripe) to automatically charge your preferred payment method for recurring orders until you modify or cancel your plan.

Your initial acceptance of these Terms constitutes your consent to recurring billing without the need for reauthorization for each renewal period.

You can manage your subscription directly through your customer account portal, including the ability to update, pause, cancel, or modify your plan at any time prior to the next renewal date.

5.2 Auto-Renewal Feature

THE SUBSCRIPTION SERVICE INCLUDES AN INITIAL CHARGE (SUCH AS FOR SHIPPING OR A PROMOTIONAL STARTER KIT), FOLLOWED BY AUTOMATIC RECURRING CHARGES BASED ON YOUR SELECTED PLAN.

BY SUBSCRIBING, YOU AUTHORIZE BUDDY BEAUTY WORKS LLC TO AUTOMATICALLY CHARGE YOUR SELECTED PAYMENT METHOD ON A RECURRING BASIS UNTIL YOU OR WE CANCEL THE SUBSCRIPTION.

Recurring charges will be processed through Shopify Payments, PayPal, or Stripe using the payment information you provided during registration. Buddy Beauty Works LLC may continue to charge your account without further notice until you submit a cancellation request in accordance with Section 10.3 of these Terms.

Your cancellation will not affect any payments already processed or scheduled before the effective cancellation date.

If your payment method is automatically updated by your provider (for example, by PayPal, Stripe, or Shopify Payments), we may use the updated information to prevent interruption of your subscription service.

In the event of a failed payment, you agree to:

• Promptly settle any outstanding balance using an alternative payment method; and

• Acknowledge that Buddy Beauty Works LLC reserves the right to suspend or cancel your subscription until the payment is successfully processed.

5.3 One-Time Purchases

In addition to subscription plans, Buddy Beauty Works LLC also offers one-time purchases of individual products through the Site. All provisions of this Agreement — including those related to pricing, delivery, returns, product use, disclaimers, and dispute resolution — apply equally to one-time purchases.

By placing any order through our Site, whether as part of a subscription plan or a single transaction, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

 

6. PAYMENT AND PRICING

6.1 Pricing Adjustments

Buddy Beauty Works LLC reserves the right to modify the prices of its products or subscription plans at any time. In the case of active subscriptions, you will receive at least ten (10) days’ prior notice by email before any pricing changes take effect on your current plan.

All prices are listed in United States Dollars (USD) and do not include taxes, shipping fees, or applicable handling charges, unless explicitly stated otherwise at checkout.

Continued use of the Subscription Service or continued purchases after a price modification constitutes your acceptance of the updated pricing.

6.2 Plan Add-Ons

Some subscription plans may include the option to add upgrades, additional products, or customized delivery preferences. Selecting or modifying these options may change the total monthly subscription fee or billing amount.

6.3 Payment

By placing an order on our Site, you agree to:

• Pay all applicable charges using one of the accepted payment methods, including Shopify Payments, PayPal, or Stripe.

• Authorize Buddy Beauty Works LLC to use an alternate valid payment method on file if your primary payment method fails.

• Authorize Buddy Beauty Works LLC and its authorized payment processors to securely process all subscription or one-time purchase transactions.

If a payment cannot be completed and is not updated promptly, Buddy Beauty Works LLC reserves the right to suspend or cancel your subscription or order until payment is successfully processed. The company may also pursue collection of any outstanding balances owed.

 

7. PRODUCT AVAILABILITY AND PROMOTIONAL INCLUSIONS

Because Buddy Beauty Works products are carefully crafted and subject to limited production runs, certain items may become temporarily unavailable. In such cases, Buddy Beauty Works LLC reserves the right to substitute products of equal or greater value in your shipment without prior notice. We will make reasonable efforts to notify you of any substitutions whenever possible.

From time to time, we may also include complimentary promotional items or gifts from Buddy Beauty Works or third-party brands. These products are not disclosed in advance and may contain ingredients that differ from those listed on your regular product pages.

If you have allergies, skin sensitivities, or fragrance intolerances, please read all product labels and ingredient lists carefully before use. You may choose not to use any promotional or gifted item at your discretion. Please note that returns or exchanges of complimentary gifts are not accepted or processed.

 

8. GIFT CARDS

Buddy Beauty Works Gift Cards are available for purchase on our website and may also be offered as part of promotional campaigns or special offers. Gift Cards:

• Must be redeemed through your Buddy Beauty Works account at www.buddybeautyworks.com.

• Apply as store credit and may be used toward eligible purchases until the balance is fully redeemed.

• Are not redeemable for cash, except as required by applicable law (for example, balances under $10 in certain U.S. states).

• Are non-refundable, non-transferable, and non-replaceable if lost, stolen, or damaged.

• Remain valid for a minimum of five (5) years from the date of issue, unless otherwise stated by law.

To redeem a low-balance card for cash in a qualifying state, please contact us at support@buddybeautyworks.com.

 

9. VOUCHERS

Buddy Beauty Works LLC may occasionally offer promotional vouchers or discount codes, including offers such as complimentary products, reduced pricing, or exclusive gifts. Vouchers:

• Require the creation of a Buddy Beauty Works account and a valid payment method.

• Are typically intended for first-time customers only, unless otherwise stated in the promotion.

• Are non-transferable, non-redeemable for cash, and valid for a single use only.

A standard promotional offer may include a complimentary full-size product or starter kit, with the customer responsible only for shipping costs, as specified in the offer details.

By redeeming a voucher or promotional offer, you agree that any associated subscription (if applicable) will automatically renew at the regular price the following month unless canceled in accordance with Section 10.3 of these Terms.

Buddy Beauty Works LLC reserves the right to deactivate, reject, or cancel vouchers that are shared on unauthorized third-party websites, duplicated, or used in a fraudulent or misleading manner.

Once a voucher has been redeemed under a specific email address, it cannot be reused or transferred, even if the related account is later deleted.

 

10. DELIVERY

10.1 Delivery Timeframe

Buddy Beauty Works LLC processes and fulfills all product and subscription orders through trusted third-party logistics providers and recognized shipping carriers.

Orders are typically delivered within 3 to 5 business days after your payment or monthly renewal has been successfully processed. Delivery times may vary depending on your location, order volume, and carrier service availability.

Once your order has been shipped, you will receive a confirmation email with tracking information to monitor your delivery status.

10.2 Delivery Conditions

Deliveries are made Monday through Saturday through Buddy Beauty Works LLC’s partnered carriers and fulfillment providers.

If you are not available at the time of delivery, your package may be left at your front door, mailbox, or another designated location in accordance with the carrier’s standard delivery procedures and local delivery policies.

Once a package has been marked as delivered by the carrier, Buddy Beauty Works LLC is not responsible for loss, theft, or damage occurring after confirmed delivery. Customers are encouraged to ensure that their delivery address is secure and accessible during standard delivery hours.

10.3 Deactivation Procedures

You may cancel your subscription at any time by logging into your account at www.buddybeautyworks.com or by sending an email to support@buddybeautyworks.com including your full name and the email address associated with your subscription.

To avoid being charged for the next billing cycle, cancellation requests must be submitted at least forty-eight (48) hours prior to your next scheduled renewal date.

If your cancellation request is received after this timeframe, the cancellation will take effect the following month, and you will still be charged for and receive your order for the current billing cycle.

10.4 Pausing Your Subscription

Buddy Beauty Works LLC allows customers to pause or skip their subscription through the customer account portal. To pause your subscription, simply log into your account at www.buddybeautyworks.com and select the pause/skip option within your subscription settings.

You will not be charged for any billing cycle during which your subscription is paused. Pausing applies only to the selected cycle, and automatic deliveries will resume with the next scheduled renewal unless the subscription is paused again before that date.

10.5 Delivery Limitations

Buddy Beauty Works LLC currently ships orders only within the contiguous United States, excluding Alaska, Hawaii, Puerto Rico, and other U.S. territories.

In the event of severe weather, natural disasters, carrier delays, or inaccessible delivery locations, Buddy Beauty Works LLC will make reasonable efforts to reschedule your delivery or provide an alternative shipping solution when possible.

Please note that delivery times may vary due to circumstances beyond our control, and such delays do not constitute a breach of these Terms.

 

11. FORCE MAJEURE

Buddy Beauty Works LLC shall not be held responsible or liable for any delay, interruption, or failure to perform its obligations under this Agreement if such delay or failure results from circumstances beyond its reasonable control (a “Force Majeure Event”).

This includes, but is not limited to, natural disasters, fires, floods, earthquakes, acts of war or terrorism, labor strikes, transportation or supply chain disruptions, pandemics, epidemics, or governmental restrictions.

Performance of the affected obligations shall be suspended for the duration of the Force Majeure Event, and Buddy Beauty Works LLC will make all reasonable efforts to resume normal operations as soon as practicable once the event has ended.

such delay or failure is due to circumstances beyond its reasonable control ("Force Majeure Event"). This includes, but is not limited to: natural disasters, acts of war or terrorism, labor strikes, transportation delays, pandemics, or governmental restrictions. Performance shall be suspended for the duration of such event, and we will make reasonable efforts to resume service as soon as possible.

 

12. RECEIPT OF PRODUCTS

Once your order is delivered by Buddy Beauty Works LLC’s partnered carriers, you are responsible for inspecting the condition of your products upon receipt.

Although Buddy Beauty Works fragrance and personal care products are not perishable, we recommend storing them in a cool, dry place and away from direct sunlight or extreme temperatures to maintain optimal quality and product integrity.

The risk of loss or damage transfers to you at the time of delivery, as confirmed by the shipping carrier.

If you receive damaged or defective products, please contact support@buddybeautyworks.com within five (5) days of receipt and include photographic evidence of the issue so that we can assist you promptly.

 

13. PRODUCT USAGE AND RECOMMENDATIONS

Each Buddy Beauty Works product includes detailed instructions for proper use on its packaging and product page. Please follow these guidelines carefully to ensure the best experience and optimal results.

If you experience any irritation, redness, or adverse reaction, discontinue use immediately and, if necessary, consult a healthcare professional.

14. RETURN AND REFUND POLICY

If you are not fully satisfied with your purchase, you may request a return and refund within thirty (30) days of receiving your order, provided that the following conditions are met:

• The product is unused, in its original sealed packaging, and in resellable condition.

• All returns must be authorized in advance by contacting support@buddybeautyworks.com and obtaining return instructions.

• Once the returned item is received and inspected, a full refund will be issued to your original payment method via Shopify Payments, Stripe, or PayPal, as applicable.

Buddy Beauty Works LLC reserves the right to reject or deny any return that does not meet these conditions or that shows signs of use, tampering, or damage not caused during shipment.

Shipping fees and promotional items are non-refundable unless otherwise required by law.

 

15. PROPRIETARY RIGHTS

All content available on the Buddy Beauty Works website, including but not limited to text, graphics, images, product designs, logos, button icons, videos, and software, is the exclusive property of Buddy Beauty Works LLC or its licensed partners, and is protected by United States and international copyright, trademark, and intellectual property laws.

Subject to this Agreement, Buddy Beauty Works LLC grants you a limited, revocable, non-exclusive, and non-transferable license to access and use the Site solely for personal and non-commercial purposes.

You may not copy, reproduce, modify, distribute, publish, transmit, display, or exploit any portion of the Site or its content without the prior written consent of Buddy Beauty Works LLC. Unauthorized use of any materials or trademarks may violate applicable laws and result in legal action.

15.1 Trademarks

“Buddy Beauty Works”, the Buddy Beauty Works logo, and all related product names, designs, slogans, and branding elements are trademarks or trade dress of Buddy Beauty Works LLC. These marks may not be used, copied, imitated, or modified without the prior written consent of Buddy Beauty Works LLC.

All other trademarks, product names, and company names mentioned or displayed on the Site are the property of their respective owners and are used on this Site for identification purposes only.

15.2 Other Content

Except for any content that you personally upload, submit, or post as a user, you acknowledge that you do not have any ownership rights over the content, materials, or media displayed, presented, or made available through the Buddy Beauty Works website.

All such content remains the exclusive property of Buddy Beauty Works LLC or its authorized licensors.

15.3 Copyright Infringement Claims

If you believe that any content appearing on the Buddy Beauty Works website infringes your copyright, please notify us by sending a written communication to support@buddybeautyworks.com that includes the following information:

• A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

• A description of the copyrighted work that you claim has been infringed.

• The specific location (URL) of the allegedly infringing material on our Site.

• Your name, address, telephone number, and email address.

• A statement of good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.

• A statement under penalty of perjury that the information provided is accurate and that you are the copyright owner or are authorized to act on their behalf.

By accessing the Buddy Beauty Works website or using any of our services, you agree to conduct yourself lawfully, respectfully, and in accordance with these Terms.

If in the future any third-party content, collaborations, or brand mentions are included, Buddy Beauty Works LLC shall not be responsible for the accuracy, completeness, or reliability of such third-party materials.

Any interactions, purchases, or engagements between you and third-party services or brands mentioned in our communications are conducted solely between you and the respective third party, and are accessed at your own risk.

 

18. USER CONDUCT

By using the Buddy Beauty Works website or any of its services, you agree to act lawfully, respectfully, and responsibly at all times.

You may not:

• Violate any applicable law, regulation, or third-party rights.

• Access, use, or attempt to use another user’s account without authorization.

• Harass, stalk, abuse, defame, or threaten others.

19.3 License to Use Content

By submitting or sharing any content, you grant Buddy Beauty Works LLC and its affiliates a non-exclusive, royalty-free, transferable, perpetual, irrevocable, and worldwide license to use, reproduce, modify, adapt, publish, distribute, display, and create derivative works from your content.

This license includes the right to use your name, image, likeness, voice, or social media handle in connection with your submitted content for marketing, advertising, promotional, or operational purposes, without any compensation to you.

This license remains in full effect even if you close your account, unsubscribe, or cease using our services.

19.4 Waiver of Rights

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUDDY BEAUTY WORKS LLC DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

BUDDY BEAUTY WORKS LLC MAKES NO REPRESENTATIONS OR WARRANTIES REGARDING THE RELIABILITY, ACCURACY, COMPLETENESS, OR AVAILABILITY OF THE SITE OR THAT ITS PRODUCTS OR SERVICES WILL MEET YOUR EXPECTATIONS OR BE FREE FROM ERRORS, DEFECTS, OR INTERRUPTIONS.

21.1 Allergen & Skin Sensitivity Notice

Some Buddy Beauty Works products may contain ingredients that could cause skin irritation or allergic reactions in certain individuals, including but not limited to fragrances, essential oils, botanical extracts, or natural preservatives.

All Buddy Beauty Works products comply with applicable U.S. Food and Drug Administration (FDA) cosmetic labeling regulations. A complete list of ingredients is printed on each product’s packaging and is also available on our official website.

You are solely responsible for reviewing all ingredient lists and understanding your own skin sensitivities or allergies before using any product. If irritation, redness, or discomfort occurs, discontinue use immediately and consult a healthcare professional.

Buddy Beauty Works LLC makes no claims, representations, or guarantees regarding the suitability of any product for specific skin types, conditions, or allergies.

21.2 Visual & Pricing Accuracy

IN NO EVENT SHALL THE TOTAL LIABILITY OF BUDDY BEAUTY WORKS LLC FOR ANY CLAIM ARISING UNDER THESE TERMS EXCEED THE AMOUNT PAID BY YOU (IF ANY) FOR THE PRODUCT OR SERVICE THAT GAVE RISE TO THE CLAIM.

This includes, but is not limited to, damages related to personal injury, emotional distress, loss of profits, data, goodwill, business interruption, or any other intangible losses, whether arising in contract, tort (including negligence), strict liability, or otherwise, even if such damages were foreseeable.

Additionally, in no event shall the total liability of Buddy Beauty Works LLC to you exceed the amount actually paid by you to Buddy Beauty Works LLC during the thirty (30) days prior to the event giving rise to such claim.

This limitation shall not apply to liability that cannot be excluded or limited under applicable law, including but not limited to personal injury or property damage directly caused by gross negligence or willful misconduct of Buddy Beauty Works LLC.

 

23. MODIFICATIONS TO THE SITE AND PRODUCTS

Buddy Beauty Works LLC reserves the right, at its sole discretion, to modify, suspend, or discontinue, temporarily or permanently, any aspect of the website, products, services, features, delivery options, subscription plans, or pricing, at any time and without prior notice.

Additionally, Buddy Beauty Works LLC may update or adjust the formulation, packaging, design, or availability of its products to reflect changes in ingredient sourcing, manufacturing processes, regulatory compliance, or product improvements.

Such modifications will not affect orders that have already been confirmed and processed prior to the change.

 

24. DISPUTE RESOLUTION & BINDING ARBITRATION

24.1 Applicability of Arbitration Agreement

You agree that any dispute, claim, or request for relief arising out of or relating to your use of the Site, the Products, or your relationship with Buddy Beauty Works LLC shall be resolved through binding arbitration on an individual basis, and not in court, except for:

JAMS arbitration provides a faster, private, and flexible resolution process, and all arbitration decisions shall be final and legally binding.

If your claim involves an amount under $10,000 USD and you cannot reasonably afford the associated arbitration fees, Buddy Beauty Works LLC will cover all reasonable arbitration costs — unless the arbitrator determines that your claim is frivolous or made in bad faith.

For your convenience, any arbitration claim under $10,000 USD may be handled:

• In writing (via email or mail), or

• In person, at a mutually agreed location.

24.3 Authority of Arbitrator

The arbitrator shall have exclusive authority to resolve any dispute or claim arising out of or relating to the interpretation, applicability, enforceability, or scope of this Arbitration Agreement, including any claim that all or part of this Agreement is invalid or unenforceable.

The arbitrator shall be authorized to grant all remedies available under applicable law, including monetary damages, injunctive relief, and declaratory judgments, and shall issue a final and binding written decision stating the essential findings and conclusions upon which the award is based.

24.4 Waiver of Jury Trial

YOU AND BUDDY BEAUTY WORKS LLC HEREBY WAIVE ANY CONSTITUTIONAL AND STATUTORY RIGHT TO A TRIAL BY JURY OR JUDGE IN ANY ACTION, PROCEEDING, OR COUNTERCLAIM ARISING OUT OF OR RELATING TO THESE TERMS, THE SITE, OR THE PRODUCTS.

All disputes, claims, or controversies between you and Buddy Beauty Works LLC shall be resolved exclusively through binding arbitration, as detailed in Section 24 above.

24.5 Waiver of Class or Collective Actions

ALL CLAIMS MUST BE BROUGHT AND RESOLVED ON AN INDIVIDUAL BASIS.

You agree not to participate in, join, or pursue any claim as part of a class action, collective action, consolidated action, or representative proceeding against Buddy Beauty Works LLC or any of its affiliates.

If a court of competent jurisdiction determines that this waiver is unenforceable with respect to a specific claim, that claim — and only that claim — shall be litigated exclusively in a state or federal court located in the State of Florida, and the remaining claims shall continue to be resolved through binding arbitration in accordance with this Agreement.

24.6 30-Day Right to Opt Out

You may opt out of this Arbitration Agreement within thirty (30) days of first becoming subject to it by sending an email to:

Your email must include your full name, email address, and a clear written statement indicating that you wish to opt out of the Arbitration Agreement contained in these Terms and Conditions.

Opting out of arbitration will not affect any other provisions of these Terms, including those governing your relationship with Buddy Beauty Works LLC.

24.7 Severability

If any provision of this Arbitration Agreement is found to be invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, that specific provision shall be severed from the Agreement, and the remainder of the Arbitration Agreement shall continue to be valid, binding, and enforceable to the fullest extent permitted by law.

24.8 Survival

This Arbitration Agreement shall survive the termination of your account, the fulfillment or cancellation of any order, and/or your cessation of use of the Buddy Beauty Works website, products, or services.

24.9 Modification

If Buddy Beauty Works LLC updates or amends this Arbitration Agreement in the future, you will have thirty (30) days from the date of the update to reject the change by notifying us in writing at:

25. GOVERNING LAW AND VENUE

THIS AGREEMENT AND ANY DISPUTES, CLAIMS, OR CONTROVERSIES ARISING OUT OF OR RELATING TO IT SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF FLORIDA, WITHOUT REGARD TO ANY CONFLICT OF LAW PRINCIPLES OR RULES THAT MIGHT OTHERWISE APPLY.

Any legal action or proceeding that is not subject to arbitration under Section 24 shall be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and both parties consent to the personal jurisdiction and venue of such courts.

The United Nations Convention on Contracts for the International Sale of Goods (CISG) shall not apply to this Agreement.

 

26. TERM, TERMINATION AND SURVIVAL

26.1 Term

This Agreement becomes effective on the date you first access or use the Buddy Beauty Works website, products, or services, and shall remain in effect until terminated either by you or by Buddy Beauty Works LLC in accordance with these Terms.

26.2 Prior Use

You acknowledge and agree that any use of the Buddy Beauty Works website, products, or services made prior to the date on which you accepted these Terms is also governed by this Agreement.

26.3 Termination

Buddy Beauty Works LLC may, at its sole discretion, suspend or terminate your account, subscription, or access to any part of the Site or Services at any time, with or without prior notice, including but not limited to the following circumstances:

• You violate these Terms and Conditions;

• Your payment method fails repeatedly or remains outstanding;

• Such action is required by law, regulation, or governmental authority; or

• You engage in any conduct that harms the brand, reputation, or other users of Buddy Beauty Works LLC.

If your account or subscription is terminated, no refunds will be issued, except where required by applicable law or as explicitly stated in these Terms.

26.4 Effect of Termination

Termination of your account or this Agreement may include, without limitation:

• Revocation of access to your Buddy Beauty Works account and related services;

• Deletion or removal of any User Content or data stored in our systems, subject to our Privacy Policy; and

• Cancellation of any future deliveries or active subscriptions.

All provisions of this Agreement that by their nature should survive termination — including, but not limited to, those relating to ownership, intellectual property, disclaimers, limitations of liability, indemnification, dispute resolution, and arbitration — shall remain in full force and effect following termination.

26.5 No Subsequent Registration

If your account is terminated for cause, you agree not to re-register, create a new account, or attempt to access the Buddy Beauty Works website or services under a different identity, name, or email address.

Buddy Beauty Works LLC reserves the right to block, refuse, or terminate any future registration or access attempts associated with your information if your prior account was terminated for violation of these Terms or for misconduct.

 

27. SEVERABILITY AND WAIVER

If any provision of this Agreement is determined by a court or arbitrator of competent jurisdiction to be invalid, unlawful, or unenforceable, that provision shall be severed, and the remainder of the Agreement shall continue in full force and effect to the maximum extent permitted by law.

No waiver by Buddy Beauty Works LLC of any provision, term, or right under this Agreement shall be construed as a waiver of any other provision or right, whether similar or different, nor shall any failure to assert or enforce any right constitute a waiver of such right in the future.

 

28. MISCELLANEOUS

This Agreement, together with our Privacy Policy and any other legal notices or supplemental terms published by Buddy Beauty Works LLC, constitutes the entire agreement between you and Buddy Beauty Works regarding your access to and use of the Site, Products, and Services.

You may not assign or transfer any of your rights or obligations under this Agreement without prior written consent from Buddy Beauty Works LLC. The company may assign, transfer, or delegate its rights or obligations under this Agreement at any time and without restriction.

Nothing in this Agreement shall be construed as conferring any third-party beneficiary rights, and no third party shall have any right to enforce any provision of this Agreement.
